1. Acceptance of Terms

Welcome to Menuo. These Terms and Conditions ("Terms") govern your access to and use of the Menuo mobile application and all related services (collectively, the "Services"). By accessing or using our Services, you agree to be legally bound by these Terms.

If you do not agree with any part of these Terms, you must not use our Services.

2. Service Description

Menuo is a mobile platform that connects users with restaurants offering daily lunch menus. The Services include:

  • Search and discovery of nearby restaurants
  • Display of updated daily menus
  • Review and rating system
  • Tools for restaurant owners to manage their menus
  • Map and location features
  • Custom notifications and alerts

3. Eligibility

You must be at least 16 years old to use our Services. By using Menuo, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into this binding agreement
  • You are not prohibited from using the Services under applicable laws
  • You will comply with these Terms and all applicable laws

4. User Accounts

4.1 Registration

To access certain Menuo features, you must create an account. When creating an account, you agree to:

  • Provide accurate, complete and up-to-date information
  • Maintain the security of your password
  • Notify us immediately of any unauthorised use of your account
  • Be responsible for all activity under your account

4.2 Account Types

  • Diner account: To search restaurants, view menus and post reviews
  • Restaurant owner: To manage restaurant information, menus and respond to reviews

4.3 Suspension and Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Provide false or misleading information
  • Engage in fraudulent or illegal activity
  • Harass or offend other users

5. Acceptable Use

5.1 Prohibited Conduct

When using Menuo, you must NOT:

  • Post false, misleading, defamatory or offensive content
  • Harass, threaten or intimidate other users
  • Infringe third-party intellectual property rights
  • Attempt unauthorised access to systems or data
  • Distribute viruses, malware or any malicious code
  • Use bots, scripts or automated tools
  • Reverse-engineer the application
  • Collect user information without consent
  • Post fake or paid reviews
  • Use the Services for illegal purposes

5.2 User Content

You are responsible for the content you post on Menuo, including reviews, opinions, photos and comments. By posting content:

  • You warrant that you have the necessary rights over the content
  • You grant us a worldwide, non-exclusive, royalty-free licence to use, display and distribute your content
  • You accept that the content may be publicly visible
  • You acknowledge that we cannot guarantee complete deletion of content once posted

6. Restaurant Owner Responsibilities

If you use Menuo as a restaurant owner, in addition to complying with all other Terms, you agree to:

  • Provide accurate and up-to-date information about your restaurant
  • Update daily menus regularly and accurately
  • Include correct information on prices, allergens and dishes
  • Respond professionally to customer reviews
  • Not post false reviews about your own restaurant or competitors
  • Comply with all local regulations applicable to your business

7. Reviews and Opinions

Menuo's review system lets users share their experiences. When posting reviews:

  • They must be based on real personal experiences
  • They must not contain offensive, discriminatory or inappropriate language
  • They must not reveal personal information of employees or third parties
  • They must not involve conflicts of interest (for example, reviewing your own restaurant)

We reserve the right to remove reviews that violate these principles.

8. Intellectual Property

8.1 Our Rights

Menuo and all its content, features and functionality are the exclusive property of Menuo and are protected by copyright, trademark and other intellectual property laws.

8.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable and revocable licence to use Menuo for personal, non-commercial purposes, in accordance with these Terms.

9. Privacy and Data Protection

Your privacy matters to us. Use of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

10. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Specifically:

  • We do not warrant that the Services are uninterrupted, secure or error-free
  • We do not verify the accuracy of information provided by restaurants
  • We are not responsible for the quality of food or service at restaurants
  • We do not guarantee that published menus are up to date or available
  • Reviews reflect users' personal opinions, not Menuo's

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUO AND ITS OFFICERS, EMPLOYEES AND AFFILIATES WILL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential or punitive damages
  • Loss of profits, data, use or other intangible losses
  • Damages arising from your use or inability to use the Services
  • Errors or omissions in content provided by restaurants
  • Conduct of third parties on the service

12. Indemnification

You agree to indemnify, defend and hold harmless Menuo and its affiliates from any claim, demand, loss, liability and expense (including attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party right
  • Content you post on Menuo

13. Modifications to the Services

We reserve the right to:

  • Modify or discontinue, temporarily or permanently, the Services
  • Change, suspend or discontinue any aspect of the Services
  • Impose limits on certain features
  • Restrict access to parts or all of the Services

We will not be liable to you or third parties for any modification, suspension or discontinuation of the Services.

14. Changes to these Terms

We may update these Terms from time to time. We will notify you of significant changes by:

  • Publishing the new Terms in the app
  • Updating the "Last updated" date
  • Sending an in-app notification

Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Spain, without reference to its conflict-of-law provisions.

15.2 Jurisdiction

Any dispute related to these Terms will be subject to the exclusive jurisdiction of the courts of Spain.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Menuo.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

No waiver by Menuo of any term or condition will be deemed a further or continuing waiver of that term or condition.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
